    1. This Privacy Policy and Its Revisions

    1.1

    Duruper respects your privacy and is committed to protecting your Personal Data (as defined below). This is the Privacy Policy of Duruper ("Privacy Policy" or "Policy"). Please read through this to understand how and why we are using your Personal Data. This Privacy Policy is to be read concurrently with our Terms of Use ("Terms"), and other notices as may be made available to you from time to time. All capitalized terms not defined herein shall have the same meaning attributed to them in the Terms. The Platform and the Services offered are only available to those who are competent to contract, and minors are expressly excluded from using the Platform. We do not knowingly collect data relating to minors.

    We reserve the right to revise the Policy from time to time to suit various legal, business and customer requirement. Please revisit this page periodically to stay aware of any changes to this Policy, which we may update from time to time. If we modify the Privacy Policy, we will make it available through the Platform, and indicate the date of the latest revision. Your continued use of the Platform/Service after the revised Policy has become effective indicates that you have read, understood and agreed to the current version of the Policy.

    2. What Is Personal Data?

    2.1

    For the purpose of this Privacy Policy, "Personal Data" shall mean any information which is related to an identified or identifiable natural person including but not limited to any data disclosed by or obtained from any User of the Platform and shall include name, age, resume / CV, certifications, third party profile login details which you shared with us and any other personal details capable of identifying a person and any other data about the User that the User willingly submits to the Platform while using the Service.

    2.2

    The term "Personal Data" does not include, (i) any information available in government records; or (ii) de-identified (anonymous data) or aggregate consumer information.

    3. What Personal Data Do We Collect?

    3.1

    We may collect, use, store and transfer different kinds of Personal Data, which are grouped together and may include but not be limited to the following:

    • Identity Data including your first name, last name, date of birth, gender, nationality, Aadhar number, passport, resume/CV or social media profile address;
    • Professional and educational details including your work experience, rank, travel details, salary details, license details, details of courses done etc.
    • Profile Data such as username and password when you register with us as Candidate, Employer, or Partner, job searches, candidate searches, job applications, feedback and survey responses.
    • Contact Data including email address, phone number, postal address or any other contact information you provide to us.
    • Usage Data includes information about how you use our Platform and Services including searches you run, jobs you click, jobs applied, correspondences with us, etc.
    • Google login data is collected by us only if you register on our Platform using your Google account. In such a case, we only collect the name and email id provided to Google as the case may be and do not store your password provided to them on our Platform.

    3.2

    We also collect, use and share "Aggregated Data" on a selective basis. Aggregated Data means records combined data to provide generalized, anonymous information in the form of a summary report, typically for the purposes of public reporting or statistical analysis for making comparisons, or revealing information and insights that would not be observable when data elements are viewed in isolation. Aggregated Data could be derived from your Personal Data but it is not Personal Data as this data does not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of Users accessing our Platform or the type of Users accessing a specific Additional Service on our Platform etc.

    3.3

    If you are a Candidate who secured overseas employment, upon your explicit consent, we may obtain a "Medical Clearance Certificate" certifying that you are fit to travel or work as applicable which can be uploaded on the Platform to enable the Employer to download it to complete the onboarding process. Your Medical Clearance Certificate could fall under the category of sensitive personal data or Special Categories of Personal Data as defined below and we urge you not to upload/include any other details related to your health or medical history in your Medical Certificate or submit any other health or medical related information ("Other Health Information") on the Platform. Any Other Health Information uploaded by you on the Platform is at your own risk.

    3.4

    If you submit your Medical Clearance Certificate on the Platform, you understand that you are consenting to the same being stored, collected, stored, uploaded and/or processed through the Platform and also permit Duruper to share the same with prospective Employers located anywhere in the world who require the said certificate in order to provide you Services of Duruper. Your refusal to consent may make it impossible for us to complete the onboarding process for the purpose of recruitment and may preclude Duruper's ability to provide the requested Services to you. All prospective Employers are requested to comply with data protection laws while processing Personal Data collected from the Platform. You understand and confirm that Duruper shall not be held liable for any failure of third parties in complying with applicable laws of privacy and protection of Personal Data.

    3.5

    Other than Data collected for providing additional services such as Medical Clearance Certificate, emigration clearance certificate and police clearance etc. we do not collect, store or process any other "Special Categories of Personal Data" which shall mean your sensitive personal data including your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data.

    3.6

    Failing to provide any of the details we request may result in us not being able to effectively provide our Services including inability to register you on our Platform and accordingly your inability to access Services that only registered Users are eligible to use.

    3.7

    We do not collect financial information like credit card / debit card number, expiry date, billing address or CVV number on our Platform and all payments made to Duruper will be re-directed to the payment gateway provider's site from our Platform. The terms of use and privacy policy of such payment gateway will be applicable to your Personal Data collected by them for processing your payment and Duruper shall not be responsible or liable for any data that you may share with the payment gateway provider for the said purpose.

    4. How Do We Collect Personal Data?

    We use different methods to collect data from and about you including through:

    4.1

    Information you provide us: We collect your Personal Data which you provide to Us directly. This may include your username, password, mobile number, e-mail address and other details you upload when register with the Platform and communications between Users and us.

    4.2

    Automated information: We may automatically track certain Information about you based upon your behavior, acts, subscriptions and preferences on our Platform. We may include certain technical Information with respect to your device. Other automatic information that we collect include account information, purchase or redemption information, page-view and clicks information, or other information about your interactions with businesses with which we operate co-branded offerings, who assist us in our targeted marketing, or for which we provide technical, fulfilment, advertising, or other services, search results and links, including paid listings.

    4.3

    Information from third parties or publicly available sources: We may receive information about you from third parties, such as Google.

    4.4

    Consent based information: We also collate location information or specific information which is collected by us after you enable the necessary permissions to us through our Platform.

    5. Your Consent

    5.1

    As a User of our Platform and Services, we seek your Personal Data in order to activate your User account, provide you with Services, provide you with a safe, efficient, smooth and customized experience on the Platform, communicate with you about the status of your account and for various other purposes set out in this Privacy Policy. The Personal Data you provide to us such as your name, company name, address, telephone number, email address and certain other information will be used to create a User name and private password, which will become part of your account information on the Platform. By providing such Personal Data to us and by availing our Services, you voluntarily consent to the collection, use and disclosure of such personal information as specified in this Privacy Policy. The legal basis of processing your Personal Data is to provide you with our Services.

    6. Using Your Personal Data on the Platform

    6.1

    We will use your Personal Data only in accordance with applicable law and for our legitimate interests including administration of the Platform, business and communications with Users, protection of our legal rights or of the Users. In accordance with certain features of the Platform/Services, we may only act as a passive conduit for the online distribution and publication of your Personal Data.

    6.2

    Most commonly, we will use your Personal Data in the following circumstances:

    • To provide you our Services (including ancillary and facilitation services provided through our Partners;
    • To help you efficiently access your User Generated Content after you sign in;
    • remember information so you will not have to re-enter it during your next visit to the Website;
    • To create your account with us;
    • To send your application including contact details to the Employer;
    • To create and upload Job Postings on the Platform and send direct intimation of Job Postings to User;
    • To match Candidate's and Employer's Job Posting;
    • To provide you with relevant search results;
    • Reach out to Candidates for Job Postings that may be relevant to the Candidate;
    • provide personalized content and information to you through newsletters, e-mails or any other methods;
    • To facilitate payment for Services or for providing payment to you under Duruper's Rewards or Referral Scheme; and/or
    • To manage our relationship with you which will include: (a) notifying you about changes to our terms or privacy policy; (b) to respond to your enquiries; and/or (c) to complete any survey.

    6.3

    Aggregated Data including Personal Data may also be used:

    • To provide, improve, test, and monitor the effectiveness of the Platform/Service;
    • To monitor metrics such as total number of visitors, traffic, and demographic patterns
    • To diagnose or fix technology problems;
    • To facilitate your use of the Platform/Service and to help you address your problems with the Platform/Service including addressing any technical problems and providing any User related services;
    • To provide you with information about our Platform/Service and to send you information, materials, and offers;
    • For our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests; and/or
    • For us to comply with a legal or regulatory obligation.

    7. Disclosures of Your Personal Data

    7.1

    We disclose your Personal Data as follows:

    • We disclose your required Resume Database and your CV to the prospective Employer for whom the Job Posting was made. Accordingly, if an entity has already accessed your Personal Data through your job application or otherwise and copied or otherwise saved your information prior to you opting out, that entity will continue to have access to the information that was previously saved.
    • Duru Recruiters have access to your Resume Database, resume/CV and your profile details including history of job applications, referrals made etc.
    • Our technical service providers have access to your Personal Data for the purpose of hosting the Platform and other necessary services which are required for the integral function of the Platform. Access to Personal Data would be disclosed only to the extent necessary for the performance of their functions. Other than Personal Data collected from you which we may share with our technical service providers who provide Platform hosting and related services and our Partners, we do not share the Personal Data we collect about you from the Platform with any other third parties (i.e. other than registered Users of the Platform).
    • Payment / financial information of the User would be shared with payment gateway service providers/Payment Partners.
    • We may share Personal Data with law enforcement agencies, courts, Government and regulatory bodies, to the extent that we are permitted or required to do so by law, or in order to comply with legal and regulatory obligations, or in the interests of national security or to respond to verified requests relating to a criminal investigation or alleged or suspected illegal activity.
    • We may share Personal Data with our other affiliates to help detect and prevent identity theft, fraud and other potentially illegal acts; correlate related or multiple accounts to prevent abuse of our Platform and/or Services; and to facilitate joint or co-branded services that you request where such services are provided by more than one corporate entity.
    • Any Personal Data that we may share with any third party providers will be done only with your specific consent.
    • We may disclose your Personal Data to the extent such disclosure is reasonably necessary to enforce our Terms, Privacy Policy or our other policies and in order to respond to claims of any other User or third-party.
    • We use your Personal Data for communication purposes, such as sending emails, newsletters and other messages to keep you informed of the Platform. You may opt-out of receiving any marketing or promotional communications from us by following the unsubscribe link. Personal Data is also used to deal with inquiries and complaints made by you relating to the Platform and to address your question, issues and other concerns.

    8. Transfer of Personal Data

    8.1

    Your Personal Data may be required to be transferred outside India and/or anywhere outside your jurisdiction. While such information is outside of India, it is subject to the laws of the country in which it is held and may be subject to disclosure to various enforcement or regulatory agencies of such other country, pursuant to the laws of such country. When Users register with us, they agree to process Personal Data as per this Privacy Policy and/or applicable privacy and data protection laws of the applicable jurisdiction.

    9. How Secure Is Your Personal Data?

    9.1

    Your Privacy is important to us, therefore Duruper is committed to preserving your Personal Data secure in accordance with the applicable laws and regulations. We have significant resources and appropriate, technical, administrative and physical procedures in place to protect your Personal information and will notify you and any applicable regulator of a breach where we are legally required to do so.

    9.2

    Notwithstanding such measures, you are informed that no method of transmission over the internet, or method of electronic storage, is fully secure, as the Internet is a vast open interconnecting network system that connects computers all over the world. Therefore, Duruper cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes.

    9.3

    You are responsible for ensuring the secrecy of your identification, passwords and/or any personal information in your possession for the use of the Platform and/or Services. Always be vigilant and careful regarding your Personal Data We are not responsible for, and cannot control, the use by others of any of your Personal Data you provide to them. We cannot assume any responsibility for the content of any Personal Data or other information which you may receive using the Platform or Services. We cannot guarantee, or assume any responsibility for verifying the accuracy of the information provided by any third party.

    10. Data Retention

    10.1

    We will maintain your Personal Data as long as your account is active and as long as needed to provide you Services. We will retain and use your information as is necessary to comply with our business obligations, legal obligations, regulatory, tax, accounting or reporting requirements resolve disputes, and enforce our agreements, to the extent necessary. We may retain your Personal Data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

    10.2

    In the event of closure of your account with us by you, we shall retain your Personal data for a certain period of time and thereafter we will delete it. Retention period can vary significantly for different types of Personal Data and the criteria for determining the appropriate retention period is subject to satisfying any legal, regulatory, tax, accounting or reporting requirements as may be required.

    10.3

    In some circumstances, we will anonymize your Personal Data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

    11. Right to Access, Update and Delete Your Personal Data

    11.1

    Depending on the circumstances, you have the right to:

    • Request access to your Personal Data to receive a copy of the Personal Data we hold about you.
    • Request correction of the Personal Data to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us. It is important that the Personal Data we hold about you is accurate and current. Please keep us informed if your Personal Data changes during your relationship with us.
    • Request erasure of your Personal Data to ask us to delete or remove Personal Data where there is no good reason for us continuing to process it. We will process your request in accordance with the applicable law.
    • Object to processing of your Personal Data if you believe it impacts your fundamental rights and freedoms. Please note that we have compelling legitimate grounds to process your information which override your rights and freedoms and may not in all cases comply with your request.
    • Request restriction of processing of your Personal Data to ask us to suspend the processing of your Personal Data in specific legal instances.
    • Request the transfer of your Personal Data to you or to a third party, only if such information is automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
    • Withdraw consent where we are relying on consent to process your Personal Data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain Services to you. We will advise you if this is the case at the time you withdraw your consent.

We may also contact you to ask you for further information in relation to your request to speed up our response.

    12.3

    You will not have to pay a fee to access your Personal Data (or to exercise any of the other rights). We may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

    12.4

    We collect/ access information from the device you access the Platform including but not limited to device information and location information when you use our Platform. You may change your consent to Duruper accessing your device location information from your device settings at any time.

    You have the right to make a complaint at any time to the concerned supervisory authority for data protection issues. We would, however, appreciate the chance to deal with your concerns before you approach the supervisory authority so please contact us in the first instance.

    14. Duruper Cookie Policy

    Technologies such as cookies, web beacons, and other tracking technologies are used by Duruper. A "cookie" is a small text file that may be used, for example, to collect information about web browsing activity ("Cookie"). Cookies enable us to serve secure pages to our users without asking them to sign-in repeatedly and to store non-personally identifying information about you such as past jobs viewed and job searched conducted by your computer. These technologies are used in analysing trends, administering the Platform, tracking users' movements around the site, and gathering demographic information about our user base as a whole. With the use of cookies and tracking technologies, we can deliver faster and more accurate results and a more personalized Platform experience.

    There are three different types of cookies that we use:

    • Session Cookies: For assisting various activities during a session such as keeping you logged in between pages. Session cookies expire when the browser is closed.
    • Permanent Cookies: They can facilitate operations such as automatic login. Permanent cookies need to be deleted after a period of six months. They remain stored even when a browser is closed.
    • First or Third Party Cookies: To collect information to carry out various research into behaviour, demographics etc. These are installed by third parties We do not control the use of Cookies by third parties nor are we in any way responsible for the same.

    We also use web analytics services provided by third parties, which use cookies to collect non-personal information about details of our users' visit to the websites including IP s and the resources they access on the websites. These third-party web analytics services send reports to us and based on this reports, we understand how visitors engage with websites.
